Terms of Service
I. Definitions: In these General Terms and Conditions, "us" and "our" refer to the company sellings.ch and "you" refers to the customer.
II. Applicability of the GTC: The customer has taken note of the General Terms and Conditions listed here and agrees to them upon placing an order. These applied conditions govern the contractual relationships between sellings.ch and its customers. Both parties accept them without reservation. The General Terms and Conditions apply from the conclusion of the contract (cf. Art. IV.). Amendments and ancillary agreements to the General Terms and Conditions are only effective if they have been confirmed by us in writing. Furthermore, sellings.ch is entitled to amend these GTC at any time.
III. Prices: All prices are stated in Swiss Francs and include VAT. These prices do not include delivery charges. The amount charged to the customer corresponds to the price on the order confirmation, which also lists shipping costs and any discounts. The prices listed on the order confirmation are binding for both parties. This also applies in the event of a discrepancy between the order date and the time of delivery. Should a price be incorrectly stated due to an invoicing error, sellings.ch reserves the right to amend the price in agreement with the customer or to cancel the order.
IV. Conclusion of Contract: A binding order is concluded as soon as the customer clicks the "Buy" button on the last web order page of sellings.ch. This process constitutes the conclusion of a contract between the customer and sellings.ch. By placing the order, the customer makes an offer for the selected item(s). We reserve the right to accept or reject this offer. sellings.ch confirms acceptance of the order and further progress to the email address provided by the customer when registering on the website. The customer has no right of return or cancellation. In exceptional cases, sellings.ch may agree to a cancellation subject to a cancellation fee. This order becomes legally binding as soon as the customer receives a confirmation email from sellings.ch or Heylight, or a confirmation via Instagram/WhatsApp. This email constitutes acceptance of the customer's offer. Should errors occur in the recipient's details (e.g. incorrect address), sellings.ch cannot be held responsible for any non-delivery of the ordered item(s). By placing the order, the customer confirms that they are at least 18 years of age. The accuracy of the email address/phone number is the responsibility of the customer. All offers are non-binding until the ordering process has been fully completed. The author expressly reserves the right to change, supplement, delete or temporarily or permanently discontinue parts of the website or the entire offer without prior notice. If an order is placed via social media (Instagram/Facebook), the following additional provisions apply: The products listed on sellings.ch's social media presence constitute an offer from sellings.ch. However, a contract is not concluded merely by the customer contacting sellings.ch. A contract is only concluded when sellings.ch sends the customer a delivery note or invoice by email. These General Terms and Conditions are deemed accepted by the customer upon receipt of the confirmation email. Orders placed via social media may also be subject to an installment plan. Reference is made to the provisions on installment plans. Insofar as payment processing is carried out by external payment service providers, the customer additionally agrees to the General Terms and Conditions of the respective service providers. The applicable General Terms and Conditions can be viewed on the respective websites.
V. Products: Photos of sellings.ch products are not subject to contractual agreements. Should deviations from the actual products occur, sellings.ch cannot accept any responsibility. Minor deviations are possible. The customer must inform themselves about the compatibility of the products before purchasing. sellings.ch disclaims all liability. Product descriptions are not advisory and are not promises. Products are sold without a road traffic approval certificate. Should the road traffic authority require a certificate, the customer is solely responsible for organizing an external assessment. sellings.ch does not cover any costs arising from the organization of such a certificate. Individually designed products cannot be returned or refunded. As products are handmade, minor deviations from the sample photos may occur. Unless there are significant errors in workmanship, such as a different color, this is considered full fulfillment of the contract. No payments may be withheld for items delivered late due to delivery delays. If the steering wheel is resold privately, sellings.ch disclaims all liability and warranty.
VI. Shipping Costs: Shipping within Switzerland is free of charge. Depending on the product, express delivery may be available for an additional fee. The price includes packaging materials. sellings.ch does not cover customs fees. Any customs fees are to be borne solely by the customer.
VII. Delivery: After receipt of payment, your order will be processed within one business day. Delivery times are:
Standard: 7-10 days
Express: 2-3 days (optional for various products)
Individually manufactured products: 14-28 days
Delivery times are calculated in business days. They are indicative and may vary. Deviations in delivery times do not give rise to any claims by the customer against sellings.ch. The purchased item is to be delivered to the customer's place of residence. The customer bears the risk of accidental loss or deterioration of the purchased item. If the customer is in default of acceptance of the purchased item, sellings.ch may either immediately withdraw from the contract and claim damages or continue to demand acceptance.
VIII. Payment processing may be carried out by sellings.ch or through one or more external payment service providers (hereinafter "service providers"). The service provider may, on behalf of sellings.ch, handle invoicing, payment processing, and debt collection. The customer agrees that the data required for payment processing may be passed on to the service provider. By selecting a particular payment method, the customer additionally agrees to the General Terms and Conditions of the respective service provider. Payment is made either as a single payment of the total amount or by setting up an installment plan of up to 24 monthly installments. For single payments, the following payment terms apply: Invoices must be paid within the deadline stated on the invoice. If payment is not made on time, the customer automatically falls into default. In the event of late payment, a reminder will be sent to the customer by email after five days. If the amount is still outstanding, the first reminder will be sent five days after the payment reminder (additional fee CHF 20.00). If the amount is still outstanding, the second reminder will be sent five days after the first reminder (additional fee CHF 20.00). If the amount remains outstanding after the second reminder, the claim may be transferred to Payment Support GmbH for further processing. From the date of transfer, further processing follows the processes and General Terms and Conditions of the engaged service provider. This includes in particular additional reminders, fees, and collection measures. The customer shall bear the costs arising from their default, including in particular the costs of an engaged collection agency within the legally permissible default damages. The calculation may be based on the recommendations of the Association of Swiss Collection Companies (VGIS). Further legally permissible costs are reserved. Payment Support GmbH is authorized to carry out all collection measures, including the initiation of debt enforcement proceedings. In the context of claims processing, default interest pursuant to Art. 104 CO and further legally permissible costs may also be charged.
For installment plans, the following payment terms apply: If the customer wishes to pay in installments, they must notify sellings.ch accordingly. Within five days of placing the order, the customer must register on the payment provider's portal and complete the order. The customer will receive the link to the portal immediately after placing the order via SMS. In the event of a negative credit check, the customer must provide sellings.ch by email within five days of placing the order with confirmation of a standing order set up for the full amount in favor of sellings.ch. If the standing order confirmation remains outstanding, sellings.ch reserves the right to dissolve the contract with the customer and cancel the delivery without further reason. sellings.ch reserves the right to dissolve an installment plan at any time, regardless of amount or payment deadline, if the customer fails to pay an installment on time. In such a case, the entire outstanding amount becomes immediately due and payable. Each installment is due at the agreed time. If payment is not made on time, the customer automatically falls into default. In this case, the claim will be processed in accordance with the above provisions. The installment payment plan constitutes an acknowledgment of debt within the meaning of Art. 82 DEBA. Should the customer's credit check be negative, the installment plan will be reduced to a maximum of 12 installments. A one-time fee of CHF 100.00 will be charged for the deletion of enforcement proceedings. This fee is to be paid by the customer. Communication in the context of payment processing and claims management may be carried out by sellings.ch or by engaged service providers, in particular electronically (e.g. email or SMS). Notices are deemed delivered as soon as they have been sent to the last known email address or contact address, regardless of whether they were actually read.
IX. Liability: These General Terms and Conditions set out all obligations and responsibilities. We are not bound by any warranties, terms and conditions, or other provisions. sellings.ch is not liable for errors caused by garages during wiring (e.g. wiring of LED cables). sellings.ch is not liable for consequential damages arising from incorrect wiring. The customer undertakes to have the products installed by a professional garage and/or specialist. Should the customer be involved in a traffic accident, any liability of sellings.ch is expressly excluded within the framework of the legal provisions. If the steering wheel is used in public road traffic (not on a race track), it is the customer's responsibility to obtain information about any necessary registrations with the road traffic authority and to carry these out. sellings.ch accordingly accepts no liability for registrations with the road traffic authority etc. sellings.ch accepts no liability for delivery delays. The risk of transport damage is borne by the customer, insofar as they cannot transfer this risk to the carrier. The transport company is liable for incorrectly deposited packages. sellings.ch bears no liability for transport defects. sellings.ch accepts no responsibility for the loss of functions or for error messages, malfunctions, or electronic impairments to the vehicle that may arise from the installation or use of the steering wheel (e.g. steering wheel heating, vibration, lane-keeping assist, etc.). All products are checked for functionality before dispatch. Installation of the delivered products is at the customer's own risk. sellings.ch will not cover installation costs. Furthermore, sellings.ch's liability for breaches of contract is excluded within the framework of the legal provisions. This exclusion does not apply insofar as sellings.ch has expressly warranted certain properties of the purchased item or has concealed them fraudulently. In particular, the following provisions on warranty cases are reserved.
X. Warranty Cases: sellings.ch grants customers a one-year warranty on the stitching of steering wheels from the date of contract conclusion. Individual cases relate exclusively to the stitching of sports steering wheels. The customer must prove that the defect was caused by sellings.ch. Wear and tear or damage caused by the customer or during installation does not constitute a warranty case. sellings.ch reserves the right to decide on a case-by-case basis and may reject any warranty claims. Defects in products or warranty claim requests must be communicated exclusively by email (info@sellings.ch). We do not accept telephone inquiries/notifications or those via social media. sellings.ch also reserves the right to provide additional warranty services. These must be made in writing and the above provisions regarding the stitching warranty apply analogously.
XI. Customer's Duty to Inspect and Give Notice: Any claims arising from a breach of contract that would have been recognizable upon customary inspection are forfeited if the customer has not notified sellings.ch within five days of delivery at the place of fulfillment. Any claims arising from other breaches of contract are forfeited if the customer has not notified sellings.ch within five days of their discovery, but no later than one year after delivery at the place of fulfillment.
XII. Retention of Title: The goods remain the property of sellings.ch until all payments under the contract have been received. If the customer is in default of payment of the purchase price, sellings.ch is entitled to register the retention of title in the retention of title register at the customer's expense.
XIII. Data Protection: The data collected is that which is necessary for processing the order or data which you provide via the contact form. Our detailed privacy policy can be found here. The processing of personal data serves the fulfillment of contractual or pre-contractual rights and obligations. The stored data will be retained by the provider until the agreed services have been duly fulfilled. Swiss data protection law applies. sellings.ch is the data controller. The customer has the right to access, rectification, erasure, restriction of processing, objection to processing, and data portability.
XIV. Copyright: The copyright and all other rights to content, images, photos, or other files on this website belong exclusively to sellings.ch or the specifically named rights holders. Written consent from the copyright holder must be obtained in advance for the reproduction of any elements.
XV. Severability Clause: Should individual provisions of these GTC be invalid or incomplete, or should fulfillment become impossible, the validity of the remaining parts of the GTC shall not be affected.
XVI. Applicable Law and Place of Jurisdiction: For all disputes arising from the contract and the GTC, the place of jurisdiction is Zurich 1. Swiss substantive and procedural law applies exclusively.
